购房人怎样才能有权依法退房?

法律分析:
依法退房的情形:
1、擅自变更规划设计;
2、开发商“五证不全”;
3、无法正常办理或延迟办理房屋产权证;
4、延期交房催告后仍不交房;
5、房屋面积误差超3%。
法律依据:
《最高人民法院关于审理商品房买卖合同纠纷案件适用法律若干问题的解释》 第二条 出卖人未取得商品房预售许可证明,与买受人订立的商品房预售合同,应当认定无效,但是在起诉前取得商品房预售许可证明的,可以认定有效。
