释义	法律分析：伤害胎儿身体的，一般不构成故意伤害罪。但倘若行为人故意使用药物或者其他器具伤害胎儿，旨在使该胎儿出生后成为严重精神病患者或者造成缺乏四肢等严重残疾，事实上也造成这种伤害的(以下简称胎儿伤害)，应当如何处理由于故意伤害罪的对象是他“人”的身体，而胎儿不是人，伤害胎儿的行为不符合伤害“他人”的要件，故认定为故意伤害罪还存在障碍。法律依据：《中华人民共和国刑法》第二百三十四条故意伤害他人身体的，处三年以下有期徒刑、拘役或者管制。
