释义	法律分析：生产者能够证明有下列情形之一的，不用为产品缺陷承担责任。 1、未将产品投入流通的。 2、产品投入流通时，引起损害的缺陷尚不存在。 3、产品投入流通时的科学技术水平尚不能发现缺陷存在的。 4、损害是由受害人的故意或重大过失造成的。法律依据：《中华人民共和国民法典》第一千二百零四条因运输者、仓储者等第三人的过错使产品存在缺陷，造成他人损害的，产品的生产者、销售者赔偿后，有权向第三人追偿。
