释义	如何认定强奸罪的多次情节对于强奸妇女、奸淫幼女“情节恶劣”的认定，目前尚无司法解释予以明确，一般由司法机关酌情予以认定。既然刑法将“情节恶劣”与《刑法》第236条第3款的其他加重情节相并列，认定“情节恶劣”的标准，亦应当与《刑法》第236条第3款第(2)至(5)项所列情节的严重性相当。司法实践中，认定是否构成“情节恶劣”，一般要结合犯罪主体、犯罪对象、犯罪手段、犯罪持续的时间、地点、次数等犯罪情节进行综合判断。
