小产权房的购房合同有效吗
释义
小产权房合同的效力以认定无效为原则，以认定有效为例外，例外的情况是：“如买卖双方都是同一集体经济组织的成员，经过了宅基地审批手续的，可以认定合同有效。”
法律依据：
国务院办公厅《关于加强土地转让管理严禁炒卖土地通知》第二条第二款 农民的住宅不得向城市居民出售，也不得批准城市居民占用农民集体土地建住宅，有关部门不得为违法建筑和购买的住宅发放土地使用证和房产证。
