（1）劳动合同没有约定或单位规章制度没有规定的情况。在既没有劳动合同约定，也没有相关规章制度对年终奖作出规定的情况下，如果离职员工上年度工作满一年，则根据工资分配应当遵循按劳分配原则，实行同工同酬其完全具备参与年终绩效考核、领取年终奖的条件。用人单位仅以年终奖发放时员工已离职而拒绝支付年终奖的，有违同工同酬的原则。可通过劳动仲裁维护自己的权益。（2）劳动合同有约定或单位规章制度有规定的情况。在劳动合同已有约定，或单位已有规章制度规定的情况下，当然应当按照劳动合同或规章制度执行。总体上，年终奖的发放属于用人单位自主管理范畴，用人单位有权自主决定年终奖发放的条件、数额、时间等具体事宜。如果用人单位在规章制度等文件中明确规定年终奖属于公司特殊福利，是否发放以及发放额度需要考虑公司当年效益及个人表现，不纳入员工工资的范围，并规定在年终奖发放前员工离职不得享受单位上年度年终奖的，那么用人单位不支付离职员工年终奖，是可以得到司法支持的。
