释义	律师分析：妨害作证罪是行为犯，只要实施了妨害作证的行为，均构成犯罪，应予立案追诉。情节严重是妨害作证罪的加重情节，所谓情节严重，主要是指行为人实施的妨害作证行为严重，侵害司法机关正常的诉讼活动，甚至使之无法进行；或者采取的手段极其恶劣等妨害作证行为。【法律依据】：《中华人民共和国刑法》第三百零七条以暴力、威胁、贿买等方法阻止证人作证或者指使他人作伪证的，处三年以下有期徒刑或者拘役；情节严重的，处三年以上七年以下有期徒刑。司法工作人员犯前两款罪的，从重处罚。
