释义	法律分析：用人单位口头辞退的，不具有法律效力。劳动者应当继续上班直至出具书面解除合同证明，避免用人单位以口说无凭按旷工处理，难以维权。用人单位拒绝上班的，可向劳动监察投诉，由劳动监察责令出具解除劳动合同证明书。对辞退违法的，可以要求经济赔偿。法律依据：《中华人民共和国劳动合同法》第八十七条用人单位违反本法规定解除或者终止劳动合同的，应当依照本法第四十七条规定的经济补偿标准的二倍向劳动者支付赔偿金。
