释义	法律分析: 劳动仲裁是指由劳动争议仲裁委员会对当事人申请仲裁的劳动争议居中公断与裁决。在我国，劳动仲裁是劳动争议当事人向人民法院提起诉讼的必经程序。按照《劳动争议调解仲裁法》规定，提起劳动仲裁的一方应在劳动争议发生之日起一年内向劳动争议仲裁委员会提出书面申请。除非当事人是因不可抗力或有其他正当理由，否则超过法律规定的申请仲裁时效的，仲裁委员会不予受理法律依据: 《中华人民共和国劳动争议调解仲裁法》第五十三条劳动争议仲裁不收费。劳动争议仲裁委员会的经费由财政予以保障。
