民法典中违约金与损失能否同时主张
释义
违约金与损失不能同时主张。如对同一违约事实同时适用约定违约金和损失赔偿，那么赔偿的数额将超过造成损害的数额，此时之违约责任则具有惩罚性，不符合补偿性为主，惩罚性为辅的原则。
