商事仲裁和劳动仲裁的不同 |
| 释义 |
劳动仲裁就是在职工与企业事实上已形成了劳动关系(或签合同或未签)的前提下，主要是解决个人和单位的劳资纠纷等问题。商事仲裁委是一个带有民间性质的机构，主要解决平等民事主体间的合同纠纷和其他财产纠纷。1、发起条件不一样，劳动仲裁由法律规章为劳动争议的必经程序。而商事仲裁只能在双方有明确具体的仲裁协议才能发起。2、仲裁结果也不一样，不服劳动仲裁可以提起诉讼，而商事仲裁则属于一裁终局，不能在提起诉讼。3、解决机构不同。民商事仲裁主要由仲裁委员会解决，而劳动仲裁由隶属劳动部门的劳动争议仲裁院解决。【法律依据】《中华人民共和国仲裁法》第二十条，当事人对仲裁协议的效力有异议的，可以请求仲裁委员会做出决定或者请求人民法院做出裁定。一方请求仲裁委员会做出决定，另一方请求人民法院做出裁定的，由人民法院裁定。当事人对仲裁协议的效力有异议，应当在仲裁庭首次开庭前提出。《劳动法》第七十九条，劳动争议发生后，当事人可以向本单位劳动争议调解委员会申请调解;调解不成，当事人一方要求仲裁的，可以向劳动争议仲裁委员会申请仲裁。当事人一方也可以直接向劳动争议仲裁委员会申请仲裁。对仲裁裁决不服的，可以向人民法院提起诉讼。
