释义	什么是离婚过错赔偿? 离婚过错赔偿制度，是指因在婚姻关系中无过错一方，同对方的过错导致离婚而遭受经济上和精神上的损害时，该受害方可以要求过错方予以赔偿的制度。我国婚姻法第四十六条规定：“有下列情形之一者，导致离婚的，无过错方有权请求损害赔偿，重婚的;有配偶者与他人同居的;实施家庭暴力的;虐待、遗弃家庭成员的。”离婚过错赔偿制度确立的目的就是对无过错方的损害予以救济，对不法行为人予以制裁，加大不法行为离婚的成本，从而保障双方自觉履行相互忠诚相扶助等义务。
