释义	通常情况下，如果都是军人，由被告住所地或被告所在的团级以上单位驻地的法院管辖。如果一方是军人，另一方不是，军人对非军人提起离婚诉讼的，那由被告住所地法院管辖。非军人对军人提起离婚诉讼，且一方是文职军人的，那由被告住所地法院管辖。如果非军人对军人提起诉讼，且一方是非文职军人，那由原告住所地法院管辖。法律依据：《中华人民共和国民法典》第一千零八十一条现役军人的配偶要求离婚，应当征得军人同意，但是军人一方有重大过错的除外。
