释义	一、缓刑的定义缓刑，全称刑法的暂缓执行，指人民法院（经过判决）对于判处拘役、三年以下有期徒刑的犯罪分子，根据其犯罪情节和悔罪表现，认为暂不执行原判刑罚，确实不致危害社会的，先行宣告定罪，规定一定的考验期，暂缓其刑罚的执行。在考验期内，犯罪分子如果不违反刑法第七十七条的规定，原判刑罚就不再执行的一种刑罚制度。二、缓刑的适用条件其一是被判处拘役或者短期有期徒刑；其二是犯罪分子确有悔改表现，法院认为暂不执行所判刑罚也不致于再危害社会；其三是罪犯不属累犯和犯罪集团的首要分子。
