如果只是单纯的放 高利贷 ，并且放高利贷的钱并不是从其他机构贷款来的，没有使用其他胁迫威胁等手段，不构成犯罪，不负刑事责任。但是如果在收贷的时候采用暴力收贷，威胁借款人等违法手段则属于违法，会坐牢判刑。
