释义	债务承担的法律规定是具体如下： 1、须有有效债务存在。债务有效存在是债务承担的前提，债务自始无效或者承担时已经消灭，即使当事人就此定有承担合同，也不发生效力。但就效力存在瑕疵的债务，在一定情形之下仍然可以成立债务承担。将来发生的债务，也可以设立债务承担，只是要等到该债务成立时才发生转移的效果。诉讼中的债务也可以有第三人承担； 2、被转移的债务应当具有可转移性。不具有可转移性的债务，不能够成为债务承担合同的标的； 3、第三人须与债务人就债务的转移达成合意。
