释义	法律分析：作为一个自然人，运动员的肖像权、商务开发等权利又是不可侵犯的。对肖像的使用关系到运动员的切身利益，而他人欲使用运动员的肖像，应当经过肖像权人的同意。一般而言，肖像权人的同意应当以明示的方式作出，默示地同意或推定也可以认定为同意。法律依据：《中华人民共和国宪法》第三十八条中华人民共和国公民的人格尊严不受侵犯。禁止用任何方法对公民进行侮辱、诽谤和诬告陷害。
