释义	法律分析：农民工一般指进城务工人员，进城务工人员是指本县（市）境内，户籍地在乡村，进入城区从事非农产业劳动6个月及以上，常住地在城区，以非农业收入为主要收入的劳动者；或外县（市）进入本县（市）城区从事非农产业劳动6个月及以上，常住地在城区，以非农业收入为主要收入的劳动者。法律依据：《保障农民工工资支付条例》第二条保障农民工工资支付，适用本条例。但条例没有对农民工下定义，近期引发讨论，根据人社部的该答复，“农民工”是指具有农村户口、有承包土地，但主要在非农产业就业的人员。
