释义	法律分析：刑法上对于想象竞合方的处罚一般是按照从一重罪的原则来进行处罚，具体而言即想象竞合犯因为行为人仅有一个行为，只是其行为所侵犯的法益是多个的，因此按照罪刑法定原则只能定一罪，即与犯罪行为所触犯的各罪中，以较重的刑罚进行处分。据此，想象竞合犯的处罚只能根据一罪名来进行处罚，虽然法益是多重的，但是只能择一重罪进行处理。法律依据：《中华人民共和国刑法》第三条法律明文规定为犯罪行为的，依照法律定罪处刑；法律没有明文规定为犯罪行为的，不得定罪处刑。
