释义	律师分析: 相同商标，是指在同一类商品中使用商标文字或图案完全一样的标记的商标。近似商标，是指与注册商标不完全相同，但在形状、读音或者含义等方面与注册商标却相同或者相近，使用在与注册商标核定使用的商品相同或者类似的商品上，易使普通消费者对商品的来源产生错误认识的商标。【法律依据】: 《中华人民共和国商标法》第三十条申请注册的商标，凡不符合本法有关规定或者同他人在同一种商品或者类似商品上已经注册的或者初步审定的商标相同或者近似的，由商标局驳回申请，不予公告。
