释义	股东抽逃出资一般是无效的。抽逃注册资本属于违法犯罪行为，这不仅侵犯了公司的利益，而且可能侵犯公司以外第三人的利益，比如公司的债权人，因此法律严令禁止，情节严重的还构成犯罪。如果发生了股东抽逃出资，那么公司或者其他股东，可以要求其向公司返还出资本息；对于协助抽逃出资的其他股东、董事、高级管理人员或者实际控制人，应当承担连带责任。【法律依据】《公司法》第二百条，公司的发起人、股东在公司成立后，抽逃其出资的，由公司登记机关责令改正，处以所抽逃出资金额百分之五以上百分之十五以下的罚款。
