释义	死刑案件的报请复核怎么规定死刑由最高人民法院核准：中级人民法院判处死刑的第一审案件，被告人不上诉的，应当由高级人民法院复核后，报请最高人民法院核准。高级人民法院不同意判处死刑的，可以提审或者发回重新审判。高级人民法院判处死刑的第一审案件被告人不上诉的，和判处死刑的第二审案件，都应当报请最高人民法院核准。” 中级人民法院判处死刑的第一审案件，被告人上诉或者人民检察院提出抗诉，高级人民法院终审裁定维持死刑判决的，报请最高人民法院核准。
