释义	法律分析：劳动者不能胜任工作，经过培训或者调整工作岗位仍不能胜任工作，由用人单位解除劳动合同的，用人单位应按其在本单位工作的年限，工作时间每满1年，发给相当于1个月工资的经济补偿金，但最多不超过12个月。法律依据：《中华人民共和国劳动合同法》第四十条劳动者不能胜任工作，经过培训或者调整工作岗位，仍不能胜任工作的，用人单位须提前三十日以书面形式通知劳动者本人或给予一个月工资后当天发出，并支付相应的经济补偿金，方可解除劳动合同。
