释义	不合法。代孕违法，但目前还没有相应的刑法进行管理，所以目前代孕只是违反了民法，不会涉及到刑法的坐牢。法律依据: 《人类辅助生殖技术管理办法》第三条人类辅助生殖技术的应用应当在医疗机构中进行，以医疗为目的，并符合国家计划生育政策、伦理原则和有关法律规定。禁止以任何形式买卖配子、合子、胚胎。医疗机构和医务人员不得实施任何形式的代孕技术。《中华人民共和国民法典》第八条民事主体从事民事活动，不得违反法律，不得违背公序良俗。
