释义	法律分析：重婚罪的主观要件是是重婚者在主观方面为直接故意，具体表现为有配偶的一方在夫妻关系存续期间又与他人成立婚姻关系，或者是重婚者明知对方有配偶而与之结婚以夫妻名义共同生活的，包括进行了结婚登记的和未登记但以夫妻关系生活的事实婚姻。如果一方确实不知与对方有配偶而与之结婚的，不构成重婚罪，反之则构成。法律依据：《中华人民共和国刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
