释义	不再购房后定金一般不能退。但如果是因为卖方的问题而不买的，比如说卖方以欺诈方式使买方在违背真实意思的情况下签订合同，该合同是可以撤销的，撤销后因该合同取得的财产，应当予以返还，这里所说的财产包括定金。法律依据：《商品房销售管理办法》第三十条房地产开发企业应当按照合同约定，将符合交付使用条件的商品房按期交付给买受人。未能按期交付的，房地产开发企业应当承担违约责任。因不可抗力或者当事人在合同中约定的其他原因，需延期交付的，房地开发企业应当及时告知买受人。
