释义	副驾驶上的人抽烟不会对其罚款，我国法律文件只对机动车驾驶人的行为做了不得抽烟打电话的规定，对于副驾驶座位的人没有这种规定，因此不会对其作出罚款或者其他处罚。《道路交通安全违法行为记分分值》第四条机动车驾驶人有下列违法行为之一，一次记2分：（二）驾驶机动车有拨打、接听手持电话等妨碍安全驾驶的行为的；（三）驾驶二轮摩托车，不戴安全头盔的；（四）驾驶机动车在高速公路或者城市快速路上行驶时，驾驶人未按规定系安全带的。
