释义	【法律意见】二审是指你对一审法院的判决不服上诉到中级人民法院才是二审；你第二次起诉离婚，仍是向基层法院申请，所以仍旧是一审程序。【法律依据】中华人民共和国民事诉讼法第四十条人民法院审理第二审民事案件，由审判员组成合议庭。合议庭的成员人数，必须是单数。发回重审的案件，原审人民法院应当按照第一审程序另行组成合议庭。审理再审案件，原来是第一审的，按照第一审程序另行组成合议庭；原来是第二审的或者是上级人民法院提审的，按照第二审程序另行组成合议庭。
