释义	法律分析: 代理合同是没有保障的。如果代理人是无权代理，则其订立的合同是效力待定的合同，要经被代理人追认后合同才对被代理人有效；如果被代理人不追认或者善意相对人予以撤销的，其订立的合同不对被代理人产生法律效力。法律依据:《《中华人民共和国民法典》》第一百七十二条【表见代理】行为人没有代理权、超越代理权或者代理权终止后，仍然实施代理行为，相对人有理由相信行为人有代理权的，代理行为有效。
