释义	1、驾驶证分不可以给别人代扣。2、代替实际驾驶人接受机动车交通违法处罚和记分并从中牟取经济利益的，处暂扣6个月机动车驾驶证，并处1000元以上2000元以下罚款。法律依据《中华人民共和国道路交通安全法实施条例》第二十六条机动车驾驶人在机动车驾驶证的6年有效期内，每个记分周期均未达到12分的，换发10年有效期的机动车驾驶证；在机动车驾驶证的10年有效期内，每个记分周期均未达到12分的，换发长期有效的机动车驾驶证。换发机动车驾驶证时，公安机关交通管理部门应当对机动车驾驶证进行审验。
