释义	有期徒刑的刑期从判决执行之日起开始计算，如果是在判决前就已经被缉拿的，羁押一日折抵刑期一日。被判处有期徒刑的犯罪分子，凡有劳动能力的，都应在监狱或者是其他劳动改造场所参加劳动，接受教育和改造。在服刑期间，若犯罪分子确有真诚悔改或者是立功表现的，可以减刑，符合一定条件的，也可以假释。法律依据：《中华人民共和国刑法》第四十七条有期徒刑的刑期，从判决执行之日起计算。判决执行以前先行羁押的，羁押一日折抵刑期一日。
