释义	法律分析：合同被确认无效后，基于该合同取得的财产应当予以返还，不能返还或者没有必要返还的，应当折价补偿。有过错的一方应当赔偿对方因此所受到的损失，双方都有过错的，应当各自承担相应的责任。因此，一般情况下，只要交付的财产没有被损毁、灭失或者被合同相对方转卖给善意第三人，则均可以要求予以返还原财产。法律依据：《中华人民共和国民法典》第一百五十四条行为人与相对人恶意串通，损害他人合法权益的民事法律行为无效。第一百五十五条无效的或者被撤销的民事法律行为自始没有法律约束力。
