自愿放弃孩子抚养权的承诺书协议书没有法律效力。离婚后，子女仍是父母双方的子女，父母需承担抚养义务。从子女出生到成年，父母都要承担抚养义务，无论经济条件和劳动能力。抚养义务是无条件的。
