释义	在飞行中的航空器上，任何使用暴力的情况都会危及飞行安全，但本罪在处刑上区分了两种情况，即：(1)尚未造成严重后果的;(2)造成严重后果的。其中“尚未造成严重后果的”，是指使用暴力对飞行安全没有造成直接的危害后果。“造成严重后果的”，主要是指因行为人在航空器中使用暴力的行为，致使航空器不能正常航行，以致迫降、坠毁等。根据本条规定，对尚未造成严重后果的，处五年以下有期徒刑或者拘役;造成严重后果的，处五年以上有期徒刑。法律依据《中华人民共和国刑法》第一百二十三条
