释义	法律分析：宅基地不能立遗嘱，宅基地上的房产可以立遗嘱。宅基地是村集体无偿划拨给村民建房的，其集体所有的性质不变，村民只有使用权，没有处分权，因而不能作为私有财产立遗嘱。法律依据：《中华人民共和国土地管理法》第八条第二款规定，农村和城市郊区的土地，除由法律规定属于国家所有的以外，属于农民集体所有;宅基地和自留地、自留山，属于农民集体所有。宅基地是村集体无偿划拨给村民建房的，其集体所有的性质不变，村民只有使用权，没有处分权，因而不能作为私有财产立遗嘱。
