释义	法律分析：醉酒驾驶罪量刑标准：根据《刑法》第一百三十三条之一规定：“在道路上驾驶机动车追逐竞驶，情节恶劣的，或者在道路上醉酒驾驶机动车的，处拘役，并处罚金。有前款行为，同时构成其他犯罪的，依照处罚较重的规定定罪处罚。” 《刑法》第四十二条规定，拘役的期限，为一个月以上六个月以下。第四十三条规定，被判处拘役的犯罪分子，由公安机关就近执行。在执行期间，被判处拘役的犯罪分子每月可以回家一天至两天；参加劳动的，可以酌量发给报酬。
