问题	重婚罪第三者有罪嘛？
释义	如果第三者是明知道对方有配偶而与之结婚的，或者以夫妻名义与有配偶者共同生活的，构成重婚罪，可以追究第三者的刑事责任。所谓明知他人有配偶而与之结婚的，是指本人虽无配偶，但明知对方有配偶，而故意与之结婚的(包括登记结婚或者事实婚)。如果没有配偶一方确实不知对方有配偶而与之结婚或以夫妻关系共同生活的，无配偶一方不构成重婚罪，有配偶一方则构成重婚罪。法律依据：《中华人民共和国刑法》第二百五十八条重婚罪，有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
