释义	在分居期间，双方的夫妻关系依然存续，根据《最高人民法院发布关于审理涉及夫妻债务纠纷案件适用法律的有关问题的解释》，明确规定夫妻双方合意表示或者一方用于家庭日常生活所负的债务，应当认定为夫妻共同债务，需要共同承担。在婚姻关系存续期间，一方超出家庭日常生活所负的债务，除非债权人能够证明该债务用于夫妻共同生活、共同生产经营或者基于夫妻双方共同意思表示，否则法院将不认定为夫妻共同债务。法律依据《最高人民法院关于审理涉及夫妻债务纠纷案件适用法律有关问题的解释》第三条、第一条、第二条
