释义	法律分析：中介收评估费违规，合同没有约定的，完全有理由拒付。评估费，是二手房贷款流程中的一步，这一步是银行的内部风险控制手段，与消费者无关。除非中介与消费者协商共同指定评估公司，那就可以收评估费，否则由中介自行承担。法律依据：《城市房屋权属登记管理办法》第十七条因房屋买卖、交换、赠与、继承、划拨、转让、分割、合并、裁决等原因致使其权属发生转移的，当事人应当自事实发生之日起90日内申请转移登记。申请转移登记，权利人应当提交房屋权属证书以及相关的合同、协议、证明等文件。
