释义	法律分析: 已经抵押的房产仍然可以查封，但不影响抵押权人行使权利。有一些已设定抵押的房地产，如果担保的债权数额较大，在拍卖该房产后可能无剩余的，人民法院就不再对该房产进行查封。已经查封的房屋不应再设定抵押。因为查封某一房产，就应当禁止对该房产进行处分。人民法院也只承认该房产在被采取查封、扣押之前已经设定的抵押权的效力。法律依据: 《中华人民共和国民法典》第二百零九条不动产的所有权，适用不动产所在地法律。本法所称的 ‘不可抗力’ ，是指不能预见、不能避免并不能克服的客观情况。
