释义	法律分析：嫖娼行为在我国并不会涉嫌构成犯罪，但也是属于违法行为，以前第一次卖淫、嫖娼被抓的，一般处以罚款，再次被抓的，属于屡教不改，一般会处以6个月到2年的劳动教养。现在没有劳动教养了，改为拘留和罚款。法律依据：《中华人民共和国治安管理处罚法》第六十六条卖淫、嫖娼的，处十日以上十五日以下拘留，可以并处五千元以下罚款节较轻的，处五日以下拘留或者五百元以下罚款。在公共场所拉客招嫖的，处五日以下拘留或者五百元以下罚款。
