释义	法律分析：承诺必须由受约人，向要约人发出。承诺是受约人同意订立合同的意思表示，并且除根据交易习惯，或当事人的要约中另有约定以外，承诺应以通知的方式，向要约人作出。法律依据：《中华人民共和国民法典》第四百七十九条承诺是受要约人同意要约的意思表示。第四百八十条承诺应当以通知的方式作出；但是，根据交易习惯或者要约表明可以通过行为作出承诺的除外。第四百八十三条承诺生效时合同成立，但是法律另有规定或者当事人另有约定的除外。
