医疗事故调解的原则有哪些 |

1、自愿原则
医疗事故赔偿调解是条例关于解决医疗事故民事责任争议的一种重要途径，是医疗事故争议解决程序的重要组成部分。卫生行政部门是否进行调解，调解能否达成协议，都取决于医患双方当事人自愿同意，卫生行政部门不能强迫医患双方当事人进行调解。
自愿原则体现在：
第一，医患双方当事人是否选择调解的自愿。选择行政调解是医患双方当事人的一种权利，不是必须履行的义务。卫生行政部门是否进行调解要尊重当事人的选择，而且这种选择必须是医患双方共同自愿的意思表示，一方不自愿也不能进行调解。在调解过程中，一方表示不愿意继续进行调解，卫生行政部门应当停止调解。
第二、医患双方当事人是否接受调解结果的自愿。医疗事故赔偿调解涉及对民事权利的处分，应当由当事人自行决定，任何单位都无权干涉。卫生行政部门不能强迫任何一方当事人接受赔偿数额的建议。
2、合法原则
卫生行政部门的调解活动和调解协议的内容必须符合法律、法规的规定。调解过程中，医患双方在卫生行政部门的主持下，可以互谅互让，可以妥协和让步，但是对于赔偿数额的确定，应当按照条例规定的标准和项目计算，应当公平合理，不能超过法律规定的限度。调解协议的内容不得损害国家和公共利益。
