收条在诉讼中是不是有效证据
释义
收条不是债务的必要证明，在诉讼中需要双方证实后方可作为有效证据。收条只证明付款和收款的事实。收据在诉讼中只有经过双方质证后才能作为有效证据被采纳。收据仅证明当事人之间发生了财产的支付和收取，但无法证明当事人之间存在债权和债务关系，因此收据并非债务的必要凭证。《民法典》第六百六十七条
借款合同是借款人向贷款人借款，到期返还借款并支付利息的合同。
