5、实际交付定金。
6、主合同有效。
一、违约定金罚则的使用条件有什么
违约定金罚则的使用条件有：
1，必须有存款的实际交付。虽然双方之间有交付存款的协议，但没有实际交付的，当双方不履行合同时，不能使用存款罚款，因为该时尚不能确认存款合同的有效成立；
2、主合同必须有效。只有当主合同有效时，才会适用定金罚款。如果主合同无效或被撤销，即使当事人已经交付并收到定金，定金罚款也不能适用；
3、当事人一方不履行合同的事实。不履行合同是指当事人根本不履行合同义务，不履行合同的行为；
4、违约与合同目的的失败之间存在因果关系。违约或合同目的的失败不一定导致定金罚款的适用。
二、合同违约金20% 的法律依据是什么
我国法律规定，当事人可以约定一方向对方给付定金作为债权的担保。定金合同自实际交付定金时成立。定金的数额由当事人约定；但是，不得超过主合同标的额的百分之二十，超过部分不产生定金的效力。实际交付的定金数额多于或者少于约定数额的，视为变更约定的定金数额。
