释义	法律分析：劳动部《工资支付暂行规定》第十一条规定：“劳动者依法享受年休假、探亲假、婚假、丧假期间，用人单位应按劳动合同规定的标准支付劳动者工资”。按该条规定，全勤奖属于劳动合同约定工资范围的，扣全勤奖违反劳动合同的约定，也就违法。反之，全勤奖不在劳动合同约定的工资范围的，用人单位依法制定的分配办法规定扣全勤奖的，则可以按规定扣出。法律依据：《中华人民共和国劳动法》第五十一条劳动者在法定休假日和婚丧假期间以及依法参加社会活动期间，用人单位应当依法支付工资。
