释义	法律分析：如果对方有事实婚姻而与其已有夫妻之实并住在一起属于重婚罪，是违法的，但仅仅是谈恋爱并且没有经济和身体上的接触那么仅仅算道德谴责并不会构成违法犯罪。法律依据：《中华人民共和国刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。对重婚的，对实施家庭暴力或虐待、遗弃家庭成员构成犯罪的，依法追究刑事责任。受害人可以依照刑事诉讼法的有关规定，向人民法院自诉;公安机关应当依法侦查，人民检察院应当依法提起公诉。
