释义	1.已经核准的公司名称享有名称权，与商标同名不存在侵权。但未经核准的公司名称可能侵权。2.已经核准的公司与商标同名虽然不存在侵权，但违反商标法第五十七条违法使用商标构成侵权。法律依据《企业名称登记管理实施办法》第二条本办法适用于工商行政管理机关登记注册的企业法人和不具有法人资格的企业的名称。第三条企业应当依法选择自己的名称，并申请登记注册。企业自成立之日起享有名称权。
