因不可抗力不能履行协议的损失由谁承担

法律分析：
不可抗力是指当事人在订立合同时不能预见其发生，人力不可避免地要面临无法克服的自然灾害和战争的客观条件。由于不可抗力造成合同违约的违约方是没有过错的，因此通常是免责的，但是法律规定由于不可抗力造成的违约方也应当承担无过错违约的责任。
法律依据：
《中华人民共和国民法典》 第五百九十条 因不可抗力致使本合同不能履行的。除法律另有规定外，不可抗力的部分或全部影响免予承担责任。迟延履行后发生不可抗力，不能免除当事人的责任。本法所称不可抗力，是指不能预见、不能避免、不能克服的客观情况。
