问题	简易程序转普通审理的程序是怎样的
释义	适用简易程序审理的案件，在法庭审理过程中，发现以下不宜适用简易程序情形的，应当决定中止审理，并按照公诉案件或者自诉案件的第一审普通程序重新审理：(1)公诉案件被告人的行为不构成犯罪的;(2)公诉案件被告人应当判处 3年以上有期徒刑的;(3)公诉。法律依据:《关于适用〈民事诉讼法〉若干问题的意见》第一百七十条适用简易程序审理的案件，审理期限不得延长。在审理过程中，发现案情复杂，需要转为普通程序审理的，可以转为普通程序，由合议庭进行审理，并及时通知双方当事人。审理期限从立案的次日起计算。
